PAIA Manual

Prepared in terms of section 51 of the Promotion of Access to Information Act 2 of 2000, as amended.

1. Introduction

This manual has been compiled in terms of section 51 of PAIA. PAIA gives effect to the constitutional right of access to information held by private bodies where the information is required for the exercise or protection of a right.

Khanyr Systems is a private body as defined in PAIA.

The Information Officer is responsible for receiving and processing PAIA requests.

5. Records held by Khanyr

Khanyr holds records in the following categories in the ordinary course of operating its business.

7. How to submit a request

Requests must be submitted in writing using the prescribed PAIA form (Form C, or the form currently prescribed by the Information Regulator), addressed to the Information Officer.

A request must include:

  • Your full name and contact details
  • The form of access requested
  • A sufficient description of the record(s) requested
  • The right you are seeking to exercise or protect (for third-party records)
  • Proof of identity

The Information Regulator's prescribed forms are available at inforegulator.org.za.

8. Timeframe

Khanyr must respond to a complete PAIA request within 30 days of receipt, subject to applicable extensions under PAIA.

9. Fees

PAIA provides for a request fee and an access fee. Applicable fees are prescribed by regulation. Confirm current fees with the Information Regulator. No request fee is payable for requests concerning your own personal information.

10. Grounds for refusal

Access to a record may be refused on grounds provided in PAIA, including mandatory protection of a third party's personal information, commercial confidentiality, legal privilege, safety of individuals, and other grounds specified in PAIA. A ground for refusal must be documented. Partial access will be considered where a full refusal is not warranted.

11. Remedies

If you are dissatisfied with Khanyr's decision, you may:

  • Ask the Information Officer to reconsider the decision
  • Lodge a complaint with the Information Regulator
  • Apply to the High Court for relief

Data subjects also have rights under POPIA, including access, correction, deletion, and the right to object to processing. These rights may be exercised by contacting the Information Officer. See our Privacy Policy for more detail.
